The original application was denied by the Hearings Officer on procedural grounds relating to submittal requirements for tree preservation. The denial was appealed by the applicant and the Three Pines Ridge Homeowners Association. The City Council declined review of the appeal and the applicant appealed to the Land Use Board of Appeals (LUBA). The applicant requested that the City withdraw the decision from LUBA for reconsideration by the same Hearings Officer who issued the original decision. This request was granted by the City as some of the issues may be able to be addressed by reopening the record before the Hearings Officer to allow additional evidence and testimony limited to the issues raised in the appeals.
